Terms of Use

These Terms of Use govern your use of the mobile game currently distributed as crypto defender (the "App"). The App is provided by Jannifer Noel Ganz ("Publisher," "we," "us," or "our"). By downloading, installing, accessing, or using the App, you agree to these Terms of Use. If you do not agree, do not use the App.

02 · Eligibility

You may use the App only in compliance with applicable law. If you are a minor under the law that applies to you, you may use the App only with permission from a parent or legal guardian.

03 · App nature and scope

crypto defender is a mobile action game. It includes arcade gameplay, gyroscope-based movement, tap-to-fire controls, optional vibration feedback, and an optional donation flow that may open a compatible external wallet application through a solana: link.

The App is for entertainment purposes only. The in-game references to USDT, SOL, ETH, BTC, meme, altcoin, nft, and similar labels are gameplay elements and do not, by themselves, represent custody, storage, exchange, brokerage, investment advice, or regulated financial services offered by us.

04 · No financial advice; no custody

We do not provide investment, legal, tax, accounting, or financial advice through the App.

We do not custody digital assets, private keys, seed phrases, or wallet credentials. If you choose to use the optional donation feature, the transaction is handled by a third-party wallet and the applicable blockchain network, not by us.

Blockchain transactions may be irreversible, may involve network fees, and may be subject to the rules, risks, delays, and failures of third-party wallet providers and blockchain infrastructure. You are solely responsible for reviewing and approving any transaction before submitting it in your wallet.

05 · License

Subject to your compliance with these Terms of Use, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the App for personal, non-commercial entertainment use.

You may not:

• copy, modify, distribute, sell, lease, sublicense, reverse engineer, or create derivative works from the App except as permitted by applicable law;
• use the App in a way that violates law or third-party rights;
• interfere with the App's normal operation, security, or integrity;
• use cheats, bots, exploits, automation, or unauthorized modifications;
• misrepresent the App, the Publisher, or any affiliation with third parties.

06 · In-game items and virtual balances

Any in-game balances, labels, scores, rewards, drops, or virtual items displayed in the App are fictional gameplay mechanics only unless expressly stated otherwise by us in writing.

They:

• have no cash value;
• are not redeemable for money, cryptocurrency, goods, or services from us;
• do not create any ownership, deposit, stored-value, or payment relationship with us.

07 · User conduct

You agree not to use the App to engage in unlawful, deceptive, harmful, abusive, infringing, or malicious conduct. You also agree not to use the App in a way that would violate app store policies, export controls, sanctions, consumer protection laws, privacy laws, or any other applicable law.

08 · Third-party services

The App may interact with third-party software or services, including wallet applications and the underlying Solana network, when you choose to use the optional donation feature. We do not control and are not responsible for third-party software, third-party terms, third-party privacy practices, transaction processing, outages, fees, or network events.

Your use of any third-party service is governed by that third party's own terms and privacy policy.

09 · Updates and availability

We may update, modify, suspend, or discontinue all or part of the App at any time, with or without notice, to improve the App, address bugs, maintain compatibility, or comply with legal or platform requirements.

We do not guarantee uninterrupted availability, error-free operation, or compatibility with every device, operating system, wallet, or network condition.

10 · Disclaimer of warranties

To the maximum extent permitted by law, the App is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that:

• the App will always be available, secure, or error-free;
• defects will always be corrected;
• the App or any third-party integration will be free of delays, interruptions, or failures;
• any donation or blockchain transaction will complete successfully.

11 · Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, digital assets, or other intangible losses arising out of or related to your use of or inability to use the App.

To the maximum extent permitted by law, our total liability for all claims arising out of or relating to the App or these Terms of Use will not exceed the greater of:

• USD $50; or
• the amount you paid directly to us, if any, for use of the App in the 12 months before the event giving rise to the claim.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

12 · Indemnity

You agree to defend, indemnify, and hold harmless the Publisher from claims, liabilities, damages, losses, and expenses arising out of or related to:

• your use or misuse of the App;
• your violation of these Terms of Use;
• your violation of any law or third-party right;
• any transaction or action you initiate through a third-party wallet or blockchain network.

13 · Termination

We may suspend or terminate your access to the App at any time if we reasonably believe you violated these Terms of Use, applicable law, or platform requirements, or if continued distribution or access would create legal, security, or operational risk.

You may stop using the App at any time by uninstalling it from your device.

14 · Governing law

These Terms of Use are governed by the laws of the United States of America, without regard to conflict of laws principles, except to the extent that mandatory law in your place of residence requires otherwise.

15 · Changes to these terms

We may revise these Terms of Use from time to time. The updated version will become effective when made available with the App or otherwise provided to users. Your continued use of the App after the updated Terms of Use become effective means you accept the revised Terms.
